Happylife said: "Hello all. I am new to this forum but i just got new problem with US bank. We had bank account with them few years ago and we had over draft protection along with our account. When we got in financial problem, they closed our account with over draft account which was us bank visa card. Since then we paid them here and there when we could and last year we started payment assistance program from June 30. We might had same program long time ago but i don't remember. When i set this program, the person i talked(it is my bad I didn't get his name) said we will do 6 months first and will see how our stuation will at the time. So we set the program June to Novenber. It was smooth and had no problem. And a person called when it expired and asked if we want to extend the program. So I extented another 6 months. And started to see on our statement that our rate went up to 28.24%. It was supposed to be 9.90%. This rate is worst than the before we started this program. I called them and asked them what is going on but seems they didn't have an answer and they said they can give us 14. something % of interest. I thought it is still better than 28.24 so I accepted it. Then next months, it again interest hasn't changed. I called them again and the person I talked tried to help me but she said the person already set the program with me so she can't change our program to new one she suggested to do. She was suppose to talk to the person set this program and call me back but it never happned. So i called again and told all the details. Then the person I talked today said our program is already expired on last Dec. and we were already on this program for 12 months and can't extend anymore. I said we are only on this program several months and just extended few months ago. And she was kept saying no we have been on this 12 months so can't extend any more and you are not on any program right now. And at this point we are not qualified to any assistance program. So I asked her then why our money is still withdrown from the bank as we set the program? She said because someone authrised so. I said, that was for this hardship program. She was just kept saying we need to put more higher amount into autmatical withdrown with them. Also she said our account is placed on collection already and our statas is re- aged. So I said we were not the one called you and begged to extemd more, you are the one called me and extended this program. I asked them to find the person setted this program with us. She said she will talk to her superviser and call back but i don't think she will. Now what is the best way to takecare of this account? don't I have a right to get this account back to where we were? they even didn't tell us account is on collection now. And that is not supposed to be happnening. We are supposed to be on hardship program. They even said account will be current when we set this program but our credit report is still showing as late payment. i have no evidence on conversation or they didn't give us any notification either. Anyone have any suggestions? Any help would be appriciated."

David said: "OP ... I hate to do this to you.. but your a prime example why we tell everyone to stay off the PHONE! As you found out the hard way... conversations on the phone are about as usefull as using sandpaper for wipeing your butt. Unless you record every conversation you have with these people your gonna be SOL in the end. What I suggest is you move higher up the chain and start demanding your money back if they were taking money out for a program they said you were not enrolled in. It is illegal for them to do that and you might want to warn them that if they do not correct the problem, you will contact your state's banking commision and any other federal agency you can think of. Request every document that they have showing your time in the program, who touched the account and when, records of the notes made when you called. Try to make life hard for them at this point. Once they see your NOT going to roll over like a good dogie, they may decide they made a mistake.. and at that point, have them apply every dime they stole from you at the agreed interest rate to your debt."
