lates

DonM said: "Just a quick question that Ive been wanting to ask but always forgot to.. I have an account (chargedOff) that is showing (31) 120 day lates after charge-off on Equifax and (6) 120 day lates after charge-off on Experian. Can they do this??? I know this is affecting my score! Best way to attack this?? ________________________________________________________________ ALSO, I have a account originally from Fleet, was charged off---Then Fleet was bought by Bank of America. Bank of America is also reporting this account as a chargeoff. They have the exact account #. I have disputed this with all 3 CRA"S and all but Experian Removed the duplicate account. I disputed again with Experian as "no knowledge of this account and duplicate accounts listed"and they both came back verified..WTF. It is out of SOL and will drop 3/07 so Im not really worried to much about it but any info would be appreciated...."

TommyV said: "Don, On the lates issue. I am in a similar situation with the DOA (Dept of Educaton) reporting some 90 and 120 day lates on an account (my only neg item). Experian, Equifax and TU are al reporting different numbers of lates. You could use one to prove to the other that they are reporting wrong but I would be carefull. I had this off one report and doing that ended up having it added to all of my accounts. Lates matter less after a year and even less after two years. Best advice is to keep disputing with each CRA and (most importantly) keep the account current. I had the exact same issue with Experian that you are having. Here is what I did: 1- Disputed with earch CRA as not mine - Came back verified 2- The account I had was with a now-defunct wireless company that was bought by another. I figured since I never had an account with the new company they probably didn't have my records. - Like a moron I wrote a goodwill letter to the President of Customer Service asking them to bring the account current and help me with a payment plan. Somehow this letter got me a letter syaing they seached using my ss# but could not locate the account. I was LUCKY, as the letter I wrote (like an idiot) was basicly DV. 3- I used that letter and sent it to TU with a 'Not Mine' - Deleted 4- Sent 'Not Mine' to Equifax with a copy of the letter from the OC and the delete letter from TU. - Deleted 5- 4- Sent 'Not Mine' to Experian with a copy of the letter from the OC, the delete letters from TU and Equifax. - REMAINS I did this every way I could. Everytime, Experian came back with a 'We can not accept your additional information" letter and the item remained. I had sent DV to the lawfirm and heard nothing back. I kept on them (everything CMRR) about the account. I threatened to sue them if they didn't remove after about 60 days. Bang - 3" package in the mail. Every statement, payment info, record of calls and a copy of my user agreement complete with all my email information, ip address and confirmation of delivery of the phone and welcome package being Fed-Exd to me. Also got a letter saying arrange a payment plan or pay in full in 10 days or we sue. This was accompanied by sworn affidavits that they had the right to sue signed by the actual attorney handling my case and a rep for the collection agency. That's when I did my 'Pay For Delete' strategy. Cost me $2000.00 but I did get it removed. I tknow I could have settled on this one for less, but really just wanted it off as it was my last negative (aside from the lates mentioned above) and my goal at this point was clean credit - not to get away without paying. The one thing about having a negetive on Experian is that it seems everyone pulls them. All the store cards (BestBuy, etc...) seem to be using them and a lot of the credit card companies do too. If you beat them, please let me know how. I am fighting to have inquiries removed from EX right now without much luck. They are a tough nut to crack."

jayb said: "yes that is their final way of screwing us over. i have an old direct merchants account doing the same thing. it was a co that i also filed BK7 on. everytime i dispute it... they screw me more by adding 180 day lates. exp. changed it from a co to several 180 day lates eq went from 4 180 day lates to 7 180 day lates this last dispute. tu just shows co without showing lates. i am not sure what to do... i was thinking of sending them threateneing letters telling them it was in bk and should be IIB, but technically i do believe it was a CO before i filed bk. trying to figure out what to do. also, i have heard they are being bought out by household bank, so maybe i should wait hoping it will be harder to verify."

oncemore said: "I also experience the exact thing; now it shows as a Chargeoff AND several 120 day lates. I'm wondering if they can do this because it was not a revolving account which would require monthly payments.???? It tanked my score after they added the 120 day lates."

jayb said: "omega... please clearify. are you talking about the adding of 120 day lates or what?"

mtnlover said: "
Dispute them as 'too old' and get them dropped that way!
I don't understand how someone disputes something as being "too old". I have some CO's and one of them BOA is still reporting 30-60-90 day lates every month after over 4 1/2 yrs. In fact, after advising them that we are out of the SOL, they continue to send CL's to us - as if they will actually generate a response or pmt. LOL ! I would love to get this off our CR's as they have now jacked up the interest owed to 3x what the orig acct bal was, and growing every month."

Omega blood said: "
omega... please clearify. are you talking about the adding of 120 day lates or what?
No, Write a letter to the FTC as inacurate reporting. I did this with a CA that was reporting the old debt as current and open. It was old and past SOL. It was removed from my CR."
