Exclamation Has anoyone been penalized for checking their account balance?

"I am so ******* SICK of Capital One! "No Hassle" MY ******* @$$, NO HASSLE!!!!

I got my online statement today, and guess what? All the charges that I contested and sent in 3 ******* "FRAUD INFORMATION FORM"s about were REPOSTED TO MY ACCOUNT!!! WHAT THE ****?!?!
I have a nice little letter sitting right here in front of me saying "I'm happy to tell you that your fraud investigation is now resolved and closed. .....As part of our $0 fraud liability promise, you were not held responsible for any fraudulent charges."

So why the **** did you put them back on my account?????
I spoke to someone (not the 'agent assigned to [my] case') who told me that this 'agent' decided to put the charges back on my card because there were phone calls from my phone to them checking my balance. WHAT??? I call and check my balance periodically so I know when I can pay my ******* bill!!!!!!
I checked my phone statements too, and guess what?? I called like 4 and 5 times (as usual) because it never does what I ask it to do!!!
So, I call again, to just cancel the ******* account and guess what! The guy was like "Well, I can cancel the account, but it won't be closed until the balance is $0 and if I have it canceled now, before you get this all straightened out with the fraud department, you will be liable for ALL charges."
**** YOU CAPITAL ONE!!!!!!!!!
So, ONCE AGAIN, I have to wait for this ***** to call me back, IF she calls me, I am so ******* sick of this ****."

Sorry for all the expletives, but I was pretty upset. Has anyone ever had this happen? Or does anyone have any advice???

Sounds like you are making the best of a bad situation. You are just going to have to keep trying.

Did you file a police report, and fill out and ID Theft Affidavit with the FTC?

The only thing that Capital one cares about is the Federal Reserve Bank. Look it up on the web and send in a complaint with a copy of your nice little letter. You might even be able to fax them.

The people that answer the phone at CRAP 1 are idiots. This is not the stupidest thing they have said, count on it. I am very sure that this has nothing to do with checking your balance, just the usual bureaucratic computer foul up. I have wiped hundreds of dollars worth of their errors with this method. I may have even posted the address for the Federal Reserve bank if you hunt around the forum. Your letters to to Crap 1 should be sent with proof of delivery. I know this may seem stupid to spend money on $30 dollar charge but it will protect you in the long run.
